私たちは、国籍法第11条改正を求める有志の会です。

現在の日本の法律では、日本人の血統で生まれた日本人が自らの意思で外国籍を取得する際、自動的に日本国籍を失ってしまいます。外国籍を取得する日本人にとって、ルーツは日本に変わりはありません。祖国である日本から自動的に除籍されるのではなく、日本国籍を保持するかどうか選択できるようにするため、私たちは国籍法第11条改正を求める運動をしています。 

2016年現在海外で生活する在外日本人の数は133.8万人。永住者の数はうち46.8万人(35%)で前年から2.5%増えています(家族、子孫、子供も含む)※1。また、日本人で国際結婚をした夫婦の数は過去10年間に毎年約2万組から4万組で、全婚姻件数の3.3%〜5.6%です※2

これらの人々はそれぞれの事情があって海外での生活を選び、中には外国籍を取得している人もいます。彼らが不本意に日本国籍と戸籍を失ってしまう場合、個人の日本人としてのアイデンティティと尊厳が傷つけられ、幸せを求める権利も侵害されてしまいます。

今年で日本人の海外移住の歴史は150周年を迎えます。

外務省発行の外交青書・白書 第4章 国民と共にある外交には下記のように記されています。

「日本人の海外移住の歴史は2016年で148年となった。北米・中南米を中心として、全世界に約360万人(推定)以上とも言われる海外移住者や日系人が在住している。移住者や日系人は、政治、経済、教育、文化を始めとする各分野において各国の発展に寄与するとともに、日本と各在住国との「架け橋」として各国との関係緊密化に大きく貢献している。」

このように、在外邦人の国際社会における「架け橋」としての役割が増え、近年各々が生活の拠点として選ぶ場所や個々のニーズと幸せの姿は多様化しています。もともと日本人であるのですから、日本国籍を維持するという選択の余地がある時代ではないでしょうか?

子供たちの未来のために:

日本人が海外を拠点として生活を送り、家族ができ、または国際結婚して家庭を持ったとしても、心は常に祖国である日本と共にあります。私たちの運動は、日本における個人の位置づけを在外邦人らが選択する権利を求めるものです。

現行の国籍法と憲法22条との矛盾:

現在の国籍法第11条1項には、明治32年(1899年)に定められた旧国籍法「第二十條 自己ノ志望ニ依リテ外國ノ國籍ヲ取得シタル者ハ日本ノ國籍ヲ失フ」の項目がそのまま維持されています。

現在の憲法22条では「何人も、外国に移住し、又は国籍を離脱する自由を侵されない」として国籍離脱が個人の「自由意思」でなされるべきだと明確にされています。それにもかかわらず、国籍法第11条は「無条件」に日本の国籍を失わせているので、憲法違反になると考えられます。 

国籍法第11条1項に対する具体的な改正策:

「日本国民は、自己の志望によつて外国の国籍取得したときは、日本の国籍を失う。」という個人の選択を許さない条文ではなく、「日本の国籍を放棄することを選択できる。」のように柔軟な解釈のできる条文に改正されるよう私たちは提案します。

なぜ今なのか?国際社会において期待される日本への経済、文化、政治的効果: 

  • 国際化に伴い日本人の海外進出が増える昨今、在外邦人たちの尊厳と祖国に対する帰属意識を守ることができる。
  • 自らの国を大切に思い国際社会における日本人としての誇りを維持することにつながり、経済、政治、科学技術や学術分野などで活躍する国際人の育成を促進できる。
  • 今後も増え続けることが予想される在外邦人の日本国籍を維持することで、日本の少子高齢化の進行を間接的に防ぐ効果が期待できる。

法務省に国民の声を届け、スムーズな国籍法改正につなげるため、この署名活動を通じてより多くの有権者の方々の理解とご協力を賜りたく存じます。みなさまの署名によるご協力をお願い申し上げます。

We are a volunteer group who seeks revision of Article 11 of the Nationality Act.

With our current law, Japanese citizens who are born as Japanese automatically lose their Japanese nationality upon voluntarily obtaining foreign nationality. Regardless of their choice to have foreign citizenship, it does not change their roots as a Japanese national. Instead of having their Japanese citizenship automatically taken away, we would like to seek options for people to select if they keep or leave their Japanese nationality. Revision of Article 11 of the Nationality Act can enable this. 

1.34 million Japanese nationals live abroad as of 2016. 35% of them are permanent residents and that number grew 2.5% from the year before.※1 Additionally, there are 20-40K (3.3% ~ 5.6%) of the population abroad who married internationally in the past 10 years -- one in 20 or 30 married couples.※2

There are varied circumstances and reasons why each of them has chosen to live abroad. Some of them have also obtained foreign citizenship to enable easier work, travel, and living. When the Japanese citizenship and family registery (Koseki) are lost involuntarily, it hurts their identity and dignity as Japanese people. Moreover, it also infringes on their individual right to seek happiness regardless of where they choose to live. 

This year marks the 150th anniversary of Japanese living abroad.

The Diplomatic Bluebook issued by Japan’s Ministry of Foreign Affairs states the roles of emigrants and Japanese descendants in the following: 

“The migration of Japanese nationals overseas has a history of 148 years as of 2016. There are an estimated 3.6 million overseas Japanese, Nikkei, with especially large numbers residing in North, Central and South America. They make positive and great contributions to the development of the countries in various fields, including politics, economy, academics and culture, and at the same time, they act as a bridge between Japan and these countries in developing close relations.

The role of Japanese living abroad as a "bridge" in the international community has increased, and the locations people choose to reside and their needs and forms of happiness have diversified. They are born as Japanese. Isn’t it time to consider the room for choice to maintain Japanese nationality for them?  

For Children’s Future:

Even if a Japanese person decides to live abroad, have a family, or marry internationally, their heart is always with their home or native land of Japan. Our activity is to seek the right for Japanese people abroad to select their identity as an individual in Japan.

Contradiction between the current Nationality Act and Constitution Article 22:

The current Article 11 of the Nationality Act is from the Old Nationality Law formed in Meiji Era in 1899 which states, “If a Japanese citizen acquires the nationality of a foreign country at his/her choice, he/she loses Japanese nationality.” 

Article 22 of The Constitution of Japan says “Freedom of all persons to move to a foreign country and to divest themselves of their nationality shall be inviolate.” It states the denaturalization of citizenship should be done by people’s “free will.” However, Article 11 of the Nationality Act forces these people to lose Japanese nationality as “mandatory,” hence it is interpreted as going against the Constitution.

Specific amendment idea for Article 11 of the Nationality Act: 

Instead of the current language that does not allow and respect people’s choice, we propose to change the language from, “If a Japanese citizen acquires the nationality of a foreign country at his/her choice, he/she loses Japanese nationality.” to, “If a Japanese citizen acquires the nationality of a foreign country at his/her choice, he/she can select to lose Japanese nationality.”

Why now? Expected economic, cultural, and political impact to Japan in the international community:

  • With the increasing number of Japanese advancing overseas, this change of law can protect their dignity and sense of belonging to their native land.
  • It leads to appreciation of their own country and helps to maintain pride as a Japanese citizen in the international community. This promotes the cultivation of world citizens who would be ambassadors of Japan and be active in economics, politics, science, technology, and academic fields.
  • Maintaining the Japanese nationality for the increasing number of Japanese living abroad can indirectly help address Japan's declining birthrate and aging population.
